Marcellise is operated by Archiify Prints Tech Limited (“Marcellise,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit www.marcellise.com, place an order, communicate with us, or otherwise use our services.

For applicable data-protection laws, Archiify Prints Tech Limited is the controller or organization responsible for the personal information described in this policy unless another entity is identified as independently responsible.

1. Personal information we collect

Depending on how you interact with us, we may collect:

  • Contact and identity information: Your name, email address, billing address, delivery address, and any phone number you provide for delivery.
  • Order and transaction information: Products viewed or purchased, cart activity, returns, refunds, discounts, payment status, and order history.
  • Payment information: Payment-card details are generally collected and processed directly by Shopify or the applicable payment provider. We normally receive transaction and payment-confirmation information rather than complete card credentials.
  • Account information: Account details, preferences, saved items, and authentication information.
  • Communications: Reviews, survey responses, customer-support messages, and other information you choose to provide.
  • Device and usage information: IP address, browser information, device identifiers, cookie identifiers, pages viewed, website interactions, referral source, and approximate location derived from an IP address.
  • Marketing information: Email engagement and interactions with our advertisements.
  • Security information: Information used for fraud prevention, account protection, and website security.

2. Sources of personal information

We may collect personal information:

  • Directly from you;
  • Automatically through cookies, pixels, local storage, and similar technologies;
  • From Shopify, payment providers, fraud-prevention providers, carriers, fulfillment providers, and customer-service providers;
  • From marketing and analytics providers, including Meta, Omnisend, and Google when Google services are enabled; and
  • From social networks or other services when you interact with our accounts or advertisements.

3. How we use personal information

We may use personal information to:

  • Operate the store and authenticate users;
  • Process payments and prevent fraudulent transactions;
  • Fulfill and deliver orders and provide tracking information;
  • Process cancellations, returns, refunds, and customer-support requests;
  • Communicate about orders, accounts, security, policy changes, and other service messages;
  • Send marketing emails through Omnisend where permitted and manage unsubscribe preferences;
  • Measure and improve the website, products, customer experience, and advertising;
  • Display and measure advertising through Meta, including interest-based or targeted advertising where permitted;
  • Measure website activity, advertising conversions, and campaign performance through Google Analytics and Google Ads when enabled and permitted;
  • Personalize content and remember preferences;
  • Detect fraud, secure the website, prevent abuse, and enforce our terms; and
  • Comply with tax, accounting, product-safety, customs, legal, and regulatory obligations and respond to lawful requests.

Where European Economic Area or United Kingdom law applies, our legal bases may include performance of a contract, compliance with legal obligations, legitimate interests that are not overridden by your rights, and consent where required, including for non-essential cookies and certain marketing activities.

4. Cookies, analytics, and advertising

We and our service providers use cookies and similar technologies to operate checkout, remember selections, prevent fraud, understand website use, communicate with customers, and measure advertising.

We currently use Shopify, Meta advertising technologies, and Omnisend.

Meta technologies may process information about website visits, product views, cart activity, and purchases to measure advertising and, where permitted, provide targeted or personalized advertising.

Omnisend processes contact, order, and email-engagement information to deliver and measure customer communications and marketing emails.

We may also use Google Analytics and Google Ads when these services are enabled. Depending on your consent choices and applicable law, Google may process device and browser information, IP addresses, cookie or device identifiers, pages viewed, website interactions, conversions, and purchase information for analytics, advertising measurement, remarketing, and personalized advertising.

Where consent is required, non-essential advertising and analytics technologies will not be activated until valid consent has been obtained. You can use our cookie banner and privacy-preference controls to make or change your choices.

Browser settings may also block some cookies, although doing so can affect certain website functions.

5. How we disclose personal information

We may disclose personal information to:

  • Shopify, which hosts the store and provides commerce, checkout, security, analytics, and related services;
  • Payment processors and financial institutions;
  • Fulfillment and logistics providers, including YunExpress, 4PX, SF Express, postal operators, customs agents, and local delivery partners;
  • Omnisend for email and customer-communication services;
  • Meta for advertising measurement and delivery, subject to your rights and consent choices;
  • Google for analytics, conversion measurement, advertising, and remarketing when Google services are enabled, subject to applicable law and your consent choices;
  • IT, hosting, security, fraud-prevention, professional advisory, customer-support, and data-service providers;
  • Government, customs, regulatory, law-enforcement, or judicial authorities when legally required; and
  • A buyer, successor, or adviser in connection with a proposed or completed merger, restructuring, financing, or transfer of the business, subject to appropriate safeguards.

We do not disclose personal information to third parties for their own unrelated purposes without authorization.

Some privacy laws define certain disclosures for targeted advertising as a “sale” or “sharing” of personal information even when no money is exchanged. Where such laws apply, you may use our privacy-preference controls to opt out.

6. Shopify

Our store is hosted by Shopify. Shopify processes personal information to provide and improve its commerce services and may act as an independent controller for certain processing activities.

Shopify’s consumer privacy information and request portal are available at privacy.shopify.com.

7. International transfers

We operate from Hong Kong SAR and use service providers that process information in multiple countries.

Your information may therefore be transferred to or processed outside your country, including in Hong Kong, Canada, the United States, and other countries where Shopify, Meta, Google, Omnisend, payment providers, fulfillment providers, and logistics providers operate.

Where required for transfers from the European Economic Area or United Kingdom, we rely on recognized safeguards such as adequacy decisions, the European Commission’s Standard Contractual Clauses, the United Kingdom International Data Transfer Addendum or Agreement, or another lawful transfer mechanism.

8. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including order fulfillment, customer support, fraud prevention, accounting, tax, customs, product safety, legal compliance, dispute resolution, and enforcement.

Retention periods vary depending on the type of record and applicable legal requirements. We delete or de-identify information when it is no longer reasonably required, unless continued retention is permitted or required by law.

9. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information.

No transmission or storage system is completely secure. Please do not send payment-card details or other sensitive financial information by ordinary email.

10. Your rights and choices

Depending on where you live, you may have the right to:

  • Request access to or information about personal information we hold;
  • Request correction of inaccurate information;
  • Request deletion, subject to applicable legal exceptions;
  • Receive a portable copy of certain information;
  • Restrict or object to certain processing;
  • Withdraw consent without affecting processing that was lawful before withdrawal;
  • Opt out of targeted advertising or processing legally defined as the sale or sharing of personal information;
  • Appeal a decision concerning a privacy request where applicable; and
  • Complain to an applicable privacy or data-protection authority.

You may submit a privacy request to support@marcellise.com. We may need to verify your identity and authority before completing a request. We will not discriminate against you for exercising a legal privacy right.

Residents of the European Economic Area and United Kingdom may complain to the supervisory authority where they live or work.

Canadian residents may have access and correction rights under PIPEDA or applicable provincial privacy law.

Australian residents may contact the Office of the Australian Information Commissioner where applicable.

Japanese residents may exercise rights available under the Act on the Protection of Personal Information.

Residents of applicable U.S. states may use the “Your Privacy Choices” or data-sharing opt-out link in our store footer. Where supported, you may also use a recognized Global Privacy Control signal.

11. Marketing choices

You may unsubscribe from promotional emails by using the unsubscribe link included in any Omnisend marketing email.

Even after unsubscribing, we may send non-promotional messages relating to orders, returns, refunds, account security, product safety, or material policy changes.

12. Children’s privacy

The store is not directed to children under 16, and we do not knowingly collect personal information from children under 16.

If you believe a child has provided personal information, contact us so we can review and delete it where appropriate.

13. Third-party links

The website may link to third-party websites or services. Their privacy practices are governed by their own notices.

We are not responsible for an independent third party’s privacy practices merely because a link appears on our website.

14. Changes to this policy

We may update this policy to reflect changes in law, technology, service providers, or business practices.

We will post the updated version and change the “Last updated” date. We will provide additional notice where required by applicable law.
